I'd drifted down a quick idea (but long post, thus not included here) around a tiered system that may provide some ideas around balance of the system between artists, labels and listeners, as well as keep some of the net radio and other yet-to-be-created distribution mediums viable for the long-tail while still compensating the popular artists that are used to commercial advantage. Some pros and cons, but I'd appreciate a read and some thoughts as to whether there's any merit in it. I'm a musician, but make my living with software development. This issue cranks me up in a number of ways.

Geof’s New Music: 1-7 Jul 2007...

When I’m not starting a shitstorm between one of the Internet’s best Webcasters and one of independent music’s best labels, I’m listening to this new-to-me music:

The Delgados’ Universal Audio.

Shiv: As the FoR that tipped Steve off to this, I can assure that, yes, it went out in Friday's mailing list---which, to me, says that Portia Sabin was indeed who sent it out. THAT she would is what made me second-guess SNR, for all the reasons that you state: it makes no sense to cut off your nose to spite your face. I've got the original if you want to see it for yourself; I excerpted it down to what Steve quoted here.

As a former terrestrial WOXY listener when I lived in Beavercreek, I wish you success!

If that e-mail is genuine, it boggles my mind. First of all, I have to assume it is Portia Sabin, the woman who RUNS Kill Rock Stars. The header would indicate it was sent to folks who have ordered music directly from their website, so that would probably be a pretty big mailing list.

How many chances for exposure do most of the releases that come out on Kill Rock Stars have except for non-comm, college, and internet radio? I would venture to guess very fucking few.

WOXY has been very supportive of KRS releases over the years but reading this seriously makes me want to pull any of their music from our airwaves for the time being. We pay a lot of money every month to SoundExchange in addition to ASCAP. BMI, and SESAC. We believe that artists should be fairly compensated and have always paid up.

I do not understand the 70% claim in this e-mail. And, as you point out, SoundExchange (an arm of the RIAA) hangs on to 50% of the collected royalties for themselves and then there's a nice chunk of the other 50% that they eventually get to keep because they "can't find" the artists that they are supposed to pay. They've got a pretty good racket going if you ask me.

It's true that smaller webcasters are not the target of this attack. SoundExchange is really going after the money from the AOL's and Yahoo's of the world...but that doesn't mean that a lot of smaller webcasters aren't going to be casualties of this attempt to squeeze that money from them.

The attempt to raise fees is one thing, but nobody is talking about the craziest fucking piece of this whole thing: RETROACTIVE PAYMENTS. It is absurd that on the deadline of July 15th that everybody is expected to pay these higher fees all the way back for A YEAR AND A HALF. That is insane. How can that possibly be fair?

These are dark days for internet radio and to have a woman behind one of the seemingly most indie labels alive stabbing smaller webcasters in the back with one little e-mail seems to indicate that nobody is above this money grab.

They deserve to be paid by their contractor - THE LABELS. No one gets paid as an artist in ANY FIELD OF ART unless their ART sells. It's bullshit and to insist on paying people just because they made a record is nuts. How about this? SELL SOME COPIES, MANAGE YOUR BUSINESS and QUIT BEGGING other businesses for a piece of the action. It's always been "you scratch our back and we'll scratch yours". If it's good and we can add it and create awareness for it, we do. If not, we don't. Once it's added, it's up to the PUBLIC whether or not they think YOUR ART is ART worthy of their hard earned MONEY.

And Sound Exchange is as full of shit as they come. I can't tell you how many times they paid me to get PDs laid and fly them to conferences for "adds". And those adds weren't important as "exposure" to generate sales and awareness? Bullshit on wheels folks and you're watching it unfold before you very eyes.

This post is great, very detailed. I agree whole heartedly. Me and my wife listen to Internet Radio everyday at work. She listens to a soft rock channel and I listen to my 80s. It's quite amazing the polotics of this whole CRB ruling. SoundExchange are old pros at this, Internet Radio is very honest and upfront about it all. I really think this is the last chance for the major record companies. It's really their choice, if congress doesn't intervene by the 15th of July the record industry will see the biggest decline of record sales ever. From what I see they financially cannot handle too many more losses. They are darn near bankruptcy now, if they dont' play this smart they are done. I wouldn't suggest pissing off millions of music fans that have been buying your product for years. Anyway, thanks for the post I hope Internet Radio survives this, and hey if they don't then either do the labels :-)
