Kennedy is... not the most clear of Supreme Court judges. In fact, I dare say several of his decisions would be better off being written in patented O&#039;Grady Q&amp;A format ;) 

And actually, historically, there have been quite a few Supreme Court judges who were not lawyers.  None since shortly before WWII, though, if I remember right.</description>
